General terms and conditions for the sale of Rotovo
Convenience translation. Only the German version is legally binding.
As of October 2026 · Version 1.0
1. Scope
1.1 These terms apply to all contracts for the purchase of the software Rotovo (licence to use, hereinafter the “Product”) concluded via the websites rotovo-app.com and rotovo.at or by email.
1.2 The seller is Dipl.-Ing. (FH) Ing. Christoph Batek, Äußere Ragnitz 59, 8047 Kainbach, Austria, VAT ID ATU73060509, email cbatek@rotovo.at, phone +43 650 3100682 (hereinafter the “Seller”).
1.3 Use of the Product is additionally governed by the End User Licence Agreement (EULA). For purchases through app stores (Google Play, Microsoft Store), the terms of the respective store apply to purchase and payment; these terms apply there only in addition.
1.4 Conflicting terms of the customer apply only if the Seller expressly agrees to them in writing.
1.5 Payment processing through Lemon Squeezy (merchant of record): Purchases through rotovo-app.com / rotovo.at are processed by our payment service provider Lemon Squeezy. Lemon Squeezy acts as authorised reseller (merchant of record) and is your contract partner for payment, invoice, VAT, refunds and the renewal of the subscription; Lemon Squeezy’s Buyer Terms (lemonsqueezy.com/buyer-terms) apply in addition. The licence to use the software is granted by the Seller (section 1.2) under the EULA; the Seller is responsible for provision, support, warranty for the software and updates. The order confirmation shows who is named as contract partner and payee.
2. Conclusion of contract
2.1 The presentation of the Product on the website is not a binding offer but an invitation to order.
2.2 By clicking “Order with obligation to pay” the customer makes a binding offer. The contract is concluded when the Seller confirms the order by email or provides the download or licence key.
2.3 The contract language is German. The Seller stores the contract text and sends it to the customer with the order confirmation by email.
3. Prices and payment
3.1 All prices are stated in euros and include statutory VAT. For customers in other EU member states, the VAT of their country of residence is charged.
3.2 Payment is made using the payment methods offered in the ordering process (e.g. credit card, PayPal); the payment service provider is named in the ordering process (section 1.5). The price of the licence is €15.00 per year (including VAT). For the first 100 subscriptions the launch price of €10.00 applies for the first licence year (a discount of €5.00); on renewal and for all further subscriptions the price is €15.00 per year. The price shown in the ordering process is decisive. The purchase price is due on conclusion of the contract.
3.3 Term, automatic renewal and cancellation: The licence is a subscription with a term of one year from conclusion of the contract or start of the download and includes updates during that time. It renews automatically for a further year each time at the price then valid (currently €15.00 per year; also for the first 100 subscriptions, whose first year costs €10.00) unless it is cancelled. You can cancel at any time with effect from the end of the current term, most easily via the subscription-management link in the confirmation email or in the Lemon Squeezy customer portal, or by email to cbatek@rotovo.at; the cancellation should arrive at least 48 hours before the end of the term so that the renewal can still be prevented. You can keep using the software until the end of the term. We will tell you about price changes for the renewal in advance; you can then cancel. For paid but unused term there is – as far as legally permissible – no pro-rata refund; your statutory rights, in particular withdrawal and warranty, remain unaffected.
4. Delivery
4.1 The Product is provided digitally: as a download link and, where applicable, a licence key by email, usually immediately after receipt of payment.
4.2 System requirements: Windows 10/11 (64-bit) with Bluetooth Low Energy or Android 7.0 or newer with Bluetooth Low Energy, and a compatible smart trainer with FTMS support. Details are in the product description.
5. Right of withdrawal for consumers
5.1 Consumers have the right to withdraw from this contract within 14 days without giving any reason. The period begins on the day the contract is concluded.
5.2 To exercise the right of withdrawal, the customer must inform the Seller (contact details in section 1.2) of the decision by a clear statement (e.g. email). For purchases through rotovo-app.com / rotovo.at an email to cbatek@rotovo.at is sufficient; we forward it to Lemon Squeezy, and the refund is made through the payment service provider. The model withdrawal form below may be used, but is not mandatory. To meet the deadline, it is sufficient to send the notice before the period expires.
5.3 In case of withdrawal, all payments are refunded without undue delay and at the latest within 14 days of receipt of the withdrawal, using the same means of payment the customer used (for purchases through rotovo-app.com / rotovo.at by Lemon Squeezy as payment processor).
5.4 Early expiry: For digital content not supplied on a tangible medium, the right of withdrawal expires if the Seller has begun the provision (download) after the customer (a) expressly agreed that provision begins before the withdrawal period expires, (b) confirmed that they are aware that they thereby lose their right of withdrawal, and (c) the Seller has sent them a confirmation of this (§ 18 para. 1 no. 11 FAGG).
Consent in the ordering process: The consent and acknowledgement under (a) and (b) are given in the ordering process by ticking a checkbox that is not pre-selected, worded: “I expressly agree that performance of the contract (the download of the app) begins before the withdrawal period has expired. I acknowledge that I lose my right of withdrawal once the download begins.” The confirmation under (c) is sent to the customer with the order confirmation. For purchases through Google Play, the terms and checkout shown there apply.

I hereby withdraw from the contract I concluded for the purchase of the following digital content: Rotovo, licence [order number]
Ordered on: ______ · Name: ______ · Address: ______
Date, signature (only if notified on paper)
6. Warranty and updates
6.1 The statutory warranty provisions apply, for consumers in particular the Austrian Consumer Warranty Act (VGG). The Seller provides, for a reasonable period, the updates required for the Product to remain in conformity with the contract.
6.2 Please report defects by email to cbatek@rotovo.at, with a description, device, operating system and, if possible, the app's diagnostic log.
7. Liability
The liability provisions of the End User Licence Agreement (EULA, section 9) apply.
8. Data protection
Personal data arising from the order (name, email, billing address, payment data) is processed solely to perform the contract and to meet statutory retention obligations. Payment data is processed by the payment service provider Lemon Squeezy as merchant of record under its own responsibility. Details: privacy policy.
9. Dispute resolution
The Seller is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
Note: The former EU online dispute resolution platform (ODR platform) was discontinued on 20 July 2025; a link to it is no longer required.
10. Final provisions
10.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of their country of residence.
10.2 The place of jurisdiction for businesses is Graz. For consumers, the statutory places of jurisdiction apply.
10.3 Should individual provisions be invalid, the rest of the contract remains in effect.
